FOR IMMEDIATE RELEASE RELEASE NO. 35-10  
CADET COURT-MARTIAL – May 24, 2010

WEST POINT, N.Y. –Cadet Kyle C. Newman, H Company, 1st Regiment, Class of 2010, will be tried by general court-martial here on Tuesday, May 25, at 3 p.m. 

Newman is charged with two violations of Article 120 Uniform Code of Military Justice (Rape), one violation of Article 120 (Indecent Conduct), and three violations of Article 92 (Violation of a Lawful General Order), of the Uniform Code of Military Justice. 

The charges carry a maximum punishment of dismissal from the Army, total forfeiture of pay and allowances, and confinement for life.  Cadets, like other members of the military, are subject to military law contained in the UCMJ, a federal statute.   The charges are only accusations; Cadet Newman is presumed innocent until proven guilty.
